Ring v. Arizona, 536 U.S. 584 (2002) [FindLaw] [Lexis], holding that the defendant has a 6th Amendment right (unless waived) to a jury determination of all factual matters necessary for the imposition of a death sentence (see also Apprendi v. New Jersey, 530 U.S. 466 (2000) [FindLaw] [Lexis]).
